On-Duty Burlington Officer Allegedly Distracted by YouTube Video Fatally Strikes Cyclist

BURLINGTON, VERMONT — In a tragic incident that raises serious questions about on-duty conduct, Shelburne Police Sergeant Kyle Kapitanski has been charged with grossly negligent operation resulting in death after fatally striking cyclist Sean Hayes. Court documents allege that at the time of the collision, Kapitanski was watching a YouTube video on his in-car computer. ​


The incident occurred in the early hours of November 11, 2024, on Shelburne Road in South Burlington. Hayes, 38, was pronounced dead at the scene. ​


According to investigators, Kapitanski's body-worn camera footage revealed that a YouTube video was playing on his cruiser’s mounted tablet at the time of the crash. The video, reportedly featuring anti-trans commentator Matt Walsh, was visible from 2:29 a.m. to 2:40 a.m., just before the collision. Additionally, crash reconstruction reports indicate that Kapitanski was driving above the posted speed limit and failed to brake immediately after the impact. 


Following the incident, Kapitanski was placed on administrative leave. He pleaded not guilty to the felony charge on March 13, 2025, and faces up to 15 years in prison if convicted. ​


The case has sparked discussions about officer conduct and accountability, especially concerning the use of electronic devices while driving. The Hayes family has filed a wrongful death lawsuit against the Town of Shelburne, alleging negligence on the part of the officer. ​
